Quite possibly true. But what political purpose is served by keeping him artificially alive? If he were declared dead, wouldn’t a Republican senator who would vote take his place?
I can’t quickly find it, but there was traffic on teh interwebs indicating that August 13 is the magic date.
If McConnell’s seat is vacated before that date, Kentucky has to call a special election…and opening the door to someone “they” wouldn’t like getting in the Senate until the victor of the November general election gets in.
I don’t recall who it is that “they” are concerned about.

Google was able to fill in part of the gap.
Kentucky state law says that if there’s more than a 3 month gap between a vacancy and the next election, a special election has to be called. 3 months or less, the Governor gets to appoint someone to fill the vacancy.
Good point, but it seems this could cut both ways, especially after Loomer’s announcement. Doesn’t maneuvering to avoid a special election hurt them in the general election? And if the general election is a sure thing, wouldn’t a special election be sure enough? So presumably they keep him alive until after the general election, too, just so it’s less obvious what was being done.

(tl;dr: Still a governor pick situation within 3 months of a regular election. However, there’s apparently a question as to whether that’s kosher per the 17th Amendment of the US Constitution.)

[tl/dr]Voting while registered at an address where hasn’t lived since an acrimonious divorce (the wrong registration address itself is a violation; the fact situation may be even worse as is unclear that he resided in the county where he was a registered, and he did vote using that registration.
I don’t think it’s an issue under the 17th Amendment - here is the text:
When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.
Given that it would be under 3 months until an election, I’d say this would fall under the temporary appointment piece.
I’m fairly certain that this SCOTUS would find whatever ruling favored the Republicans the most as the Constitutional rulling.

I’m wondering when the special election would take place were he to die or resign before Aug 3.
I know in CA we had a concurrent election for the same Senate seat: one for the “rest of the term,” and one starting in January. Same ballot.
yeah for Feinstein. That probably makes the most sense but it’s possible they could call special election in September.
I think one of the other political threads or maybe a post in this one has some options that could happen including the Gov just appointing someone and challenging some the laws.
