Doesn’t the last line of the 12th amendment read “But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States”? Won’t Trump be ineligible to be elected to the office of President in 2028?
They will just ignore that part, the same way they ignore the first part of the 2nd amendment

Agreed, I just wouldn’t consider this an established loophole, it’s something that would need to be argued. Certainly I think an originalist take on amendment 12 would strongly indicate “if you can’t run for President, you can’t run for Vice President”, but you never know how the justices would go on something like that.
A few years ago, I would have agreed that the SCOTUS would have gone along with that as the apparent intent of the 12th.
With the current crop of justices, however… I know that Alito and Thomas would definitely support Trump getting a third term via perceiving a loophole in the 12th. I wouldn’t be surprised if Kavanaugh and Gorsuch joined in.

If an R ticket wins the Presidency, they are probably winning the House, in which case they can have both Pres and VP resign (or refuse to count electoral votes if a D ticket wins) and install anyone they want by electing them Speaker first.
Yep. There is no requirement that the Speaker of the House be an elected Representative. It could be you (assuming you are at least 35 years old and a natural born citizen of the United States) or me.
