Maybe that’s why the constitution has been removed from the White House page. They’re going to revamp it and hope no one notices it’s changed.

Following a rabbit hole from a WSJ article (gift link) looking at prospects for a third Trump term, I encountered a MAGA theory for how Trump could get elected to a third term.

It does involve the “run as VP, and have the Pres resign” hack and an interpretation of the 12th Amendment that the clause

only applies for disqualifications that were in place at the time of ratification of the Twelfth…so the two-term limit from the Twentieth wouldn’t apply.

I can imagine four SCOTUS justices going along with that thought process. I don’t think they can get to five with the current court.

Of course Vance’s wife may just whisper in his ear so he doesn’t resign…

Apparently the draft language for the 22nd amendment said couldn’t serve more than 2 terms, and that was changed to elected. That implies potential intent by the authors to allow serving a 3rd time should you get there some other way.

Sure, but that was likely to allow a VP that takes over after a death or resignation to serve two full elected terms.

Ford served 0 terms as an elected President. With the original language, this term would likely count as 1 term. With the revised language, Ford could end up serving 3 terms, but only 2 of them would be as an elected President.
