Florida Man Nabbed in $7,100 Ozark Funeral Home Stretcher Theft Spree
A 58-year-old Florida man is facing felony charges in Ozark, Alabama after investigators say he stole a mortuary stretcher and cot cover worth roughly $7,100 from a local funeral home, then turned up connected to a string of similar thefts stretching across four states. Christopher Michael Johnson of Largo, Florida was arrested by deputies in his home county after a multi-agency investigation that spanned Alabama, Georgia, Florida and South Carolina.
So, stand your ground doesn’t even have to be proven?
I’m surprised more “murders” haven’t happened in FL. I mean, like, twice a day.
Even more surprising: shooter was a black female the “victim” was a white male. Good on FL for being so progressive, after holding the shooter, diligently checking her background for felonies, etc.
Had Florida Woman been prosecuted for killing Florida Man, prosecutors apparently would have had to prove that Florida Woman’s fear of “death or great bodily harm” was not reasonable.
Now, it should be noted:
The encounter was STUPID.
I am not a lawyer, but I think there were prosecutable offenses on both side (e.g., I wouldn’t be surprised if Florida Woman could have been charged with brandishing…if that’s a crime in Florida).
Opinions vary as to whether/when there is a duty to flee that supersedes a right to self-defense.
However, once we get past the insanity up to the point of Florida Woman drawing her firearm and aiming it at Florida Man… the fact that Florida Man continued to advance toward Florida Woman in an aggressive manner despite Florida Woman making her intentions very clear makes that element of “stand your ground” pretty self-evident.
The reporting that they confirmed she had no felony convictions is confirmation they checked the other key element of “stand your ground”, that the person carrying legally. Since Florida doesn’t require carry permits anymore…
(Personally, I think in a situation of this nature, Florida Woman had a moral duty to flee…but apparently the people of the State of Florida believe otherwise.)
That’s getting at the premise of whether “stand your ground” is a good/bad idea.
An argument can be made that when one is in public, and in a situation that is escalating towards violence, and there is a viable option to leave that would reduce the risk of violence towards you or another person, the moral thing to do is to take that option. In such a situation, violence, particularly potentially lethal violence, is appropriate only when there is no other option.
If Florida Woman had perceived a threat from Florida Man, but her leaving would have diffused the situation, that would have been the moral thing to do.
There are some people, and I think possibly some jurisdictions, who extend that duty to flee even to individuals’ homes. I don’t, or at least I think that in a home invasion scenario, it’s probable that there will be no viable option to leave, making the question usually moot.
Stand your ground says everyplace is equivalent to your home in this regard.
(And, of course, there is the risk of abuse in stand your ground jurisdictions as to how prosecutors, judges, and juries might judge whether the person claiming self-defense really was in a situation where they could reasonably fear “death or great bodily harm”.)
I don’t even like that Jersey has beaches that you have to pay to access.
We do it right in CA here. All beaches are public and should be accessible. Some Richy McRichfaces don’t like it here, either. They don’t like it when they buy a property next to a beach access that has been there relatively forever. They put gates on them and lock them. Shit like that.
