Plus side is when you make illegal demands of a university with a good law school, you rapidly get faculty responses.

I wonder how many laws are now also void via pocket veto if autopen is no longer viewed as valid.

FWIW, this seems to be what initiated this declaration:

Google tells me that at least one iteration of the Patriot Act and one set of tax cuts were signed by autopen.

I don’t think it’s the autopen itself that is the issue. If a staffer was abusing access to the autopen, then is there really any way to know what Biden really intended to sign and what he didn’t?
Also, given his mental state, it could be argued that he wasn’t in sound mind to be able to actually make the decisions.
Not saying I agree with what Trump did, just putting the logic out there.

It would be a deeply dangerous precedent to be able to retroactively say that a former President was not of sound mind and thus their actions don’t count.

Note: this is speculation, and if you are going to go there, Trump offers up daily reminders of ignorance and stupidity that are just as concerning as anything Biden had done publicly.

Oh, I fully agree. I wouldn’t want to go down that slope. Also, there’s a difference when the President does something on his own vs if someone else is doing it.
As I said, I’m putting some potential arguments out there.

I’ve been seeing the argument “even though Biden publicly talked about the pardons and therefore was aware, he may not have been aware when it was being signed, and if he wasn’t mentally present at the time it was signed then it’s not legal”

So we’re going to reach back in time and decide when Presidents were and were not capable based on which legislation we don’t like?

It would be amusing if pardons were reversible like executive orders, and the insurrectionists had to be locked up every other 4 years
