What i read is the protest he was in disrupted church services? Sounds like trespassing which would nullify his reporter status?
My understanding is that reporters are generally given broad allowances to cover protests, with the factors being considered including whether or not they are credentialed and whether they are observing or exacerbating the situation. On 1/6, multiple people who self-identified as journalists were charged, but they were independent, not credentialed people who were caught on camera damaging federal property. The majority of journalists who were at the Capitol on 1/6 were not charged.
On those lines, if Lemon was at the protest and observing, it would be unusual to charge him. And about 90% of the protestors there that day are not being charged. My understanding is he is being charged with conspiracy as an organizer, and at least one federal judge refused to issue the arrest warrant so it isn’t clear how strong the evidence is. It certainly feels like he is partially being charged with being an outspoken critic of Trump.
Plus he’s black which makes it doubly bad in Trump world.

It’s also a reminder that ICE arresting people as they leave church = good, protesting at a church = bad according to our government (personally, I’m opposed to both)

Still, seems like a lot of work to track Lemon down in L.A. (lives in NY) and arrest only him and one other journalist. They could have detained hundreds of illegals with the time they waste on a single person.

Multiple people have been charged in connection with the protest, when demonstrators entered St. Paul’s Cities Church after discovering that one of its pastors is an ICE official.

The law Bondi cited in her announcement — 18 U.S. Code § 241 — describes it pertaining to when “two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States.”
This doesn’t apply to I.C.E., of course.
I dont think a group of protestors should be going into a church with their protest. If Lemon went in as a reporter and not an active participant, the charges are BS. Being a well known journalist does not give him an excuse to avoid charges.
I am sure Fox News’ long time obsession with him is a motivating factor for bringing charges.
The Legal Eagle footage clearly shows Lemon in the church saying he isn’t one of the protesters and that he’s only reporting on it.
Legal Eagle dedicates a few seconds on the trespassing idea. It’s a generally a misdemeanor and could result in a small fine and that’s what commonly happens when people get arrested at protests - if they’re charged.
Another thing covered by Legal Eagle. The judge said there was no good reason for an arrest warrant (likelihood a suspect would flee, danger to people, etc) and they should just take it to a grand jury. That’s what eventually happened. It’s not clear whether the two week lag means it took them two weeks to find a grand jury willing to charge them or if they were just being lazy.
