Rudy Giuliani has not only not turned over to Moss and Freeman the specific possessions that the court ordered him to give them, he showed up to a polling place today in FL in the antique car that he owes them. Someone is going to go to jail for contempt.

Right, but then you realize there are people who are struggling to pay bills who will send him $50, $100 or more and probably do that more than once.

I don’t think he could sell the Mercedes for cash. His creditors would seize the cash.

OTOH, he could use it as an Uber vehicle. Mercedes convertible might be worth a little extra.

His creditors can seize the car… assuming it’s his.

The court has ordered him to turn over the car as of 2 weeks ago. He’s still using it.

After some period of time the creditor can get the sheriff to seize it.

That said, my dad is constantly harping that we have a debt collection problem in this country. (Probably we are not alone in that but I don’t know how it works in other countries.)

And the proof of that is that they had to create a special category of debt for child support because it’s so difficult to collect debts that ordinary single moms largely wouldn’t be able to do it without the help of a government agency. But that agency exists only for child support and possibly spousal support. There is no government agency to help Giuliani’s creditors collect that debt.

i assumed that if you fail to meet the deadlines and thoroughness required of court ordered asset forfeiture that the courts would be involved in compelling compliance

I think the responsibility is generally on the creditors to understand the process and initiate next steps.

Certainly you have to get the police involved before you just start seizing things.

seems off to me, wouldn’t think a judgement would force someone out of the primary residence (assuming can meet any payments) and appliances are assumed to be part of it as well. You couldn’t sell a home without a refrigerator (can replace if you love it), oven, light fixtures, bathroom fixtures… Dish & Clothes washers if already have.

Would be shocked any of these items would be included in a settlement or even have much value sold used

I’ve purchased a home sans refrigerator, but I agree with you that I’m surprised he’s expected to give it up to his creditors.

Unless there’s more than one fridge, I guess. If it’s like a kegerator or a wine chiller or a fridge for the bar / game room / basement / garage then that’s different.

But the primary fridge in the main kitchen… seems like something he honestly ought to be able to keep under my understanding of the law.

The article also mentioned “luxury watches”, a Mercedes Benz that used to belong to Lauren Bacall, sports memorabilia including a shirt signed by Joe DiMaggio (which his lawyers argued was clothing and did not need to be turned over).

I think all that stuff should be turned over… including the Joe DiMaggio shirt, which should be treated as the collector’s item that it is.
