I would guess they’ll go with hormone therapy as being an obstacle to service. I am not familiar with the ins and outs, but until fairly recently I was under the impression that being on almost any sort of regular medication meant you were ineligible for a lot of jobs in the military.

The problem that they are facing legally is that the EO banning trans service members said:

adoption of a gender identity inconsistent with an individual’s sex conflicts with a soldier’s commitment to an honorable, truthful, and disciplined lifestyle, even in one’s personal life. A man’s assertion that he is a woman, and his requirement that others honor this falsehood, is not consistent with the humility and selflessness required of a service member.

and government actions based on animus are not allowed.

Imagine showing up to court unprepared in a case in which the judge has previously reamed you out for being unprepared. Maybe when you have no legs to stand on you give up?

A federal judge stopped a hearing about Donald Trump’s ban on transgender military service members in its tracks Wednesday, calling for a recess from proceedings to invite the Department of Justice’s lawyer to actually read up on the policy they were defending.

U.S. District Judge Ana C. Reyes had criticized the department’s lawyer for not having read three reports that Defense Secretary Pete Hegseth cited in his policy banning transgender members of the military, according to Politico’s senior legal affairs reporter Kyle Cheney, who posted several updates on the hearing on X.

Reyes requested that the court take a 30-minute break, and asked the department’s lawyer to review the reports and compare how they’d been misquoted by Hegseth in his policy. Then, they could tell her whether they believe she could reasonably rely on Hegseth’s interpretation of those reports.

When the court resumed, Reyes pointed out that one study Hegseth had relied on to demonstrate that transgender service members hurt troop readiness and weaken their unit, actually concluded the exact opposite. The study found that transgender service members were more deployable, and experienced fewer lapses in their service than those diagnosed with depression, who were not automatically excluded from service.

So heres a question. In insurance forms where you have to categorize yourself mostly into m/f, what should the field title be? Sex? Gender? Something else?

Are you trying to segment on the basis of sex or gender?

It might depend on the insurance. Maybe you want gender for auto insurance and sex for life insurance? It also might not matter very much. It’s a fairly small number of people who might answer differently, and there are barriers to anyone picking and choosing, so there might not be enough pricing distortion to matter. Many jurisdictions disallow sex and gender as rating variables for auto insurance, and that hasn’t led to problems with the line in those jurisdictions.

The big difference in risk here is mostly for youthful drivers anyway.

Okay to post encroachment on gay rights here? It could be argued that trans people generally have things worse, but all queer people are in danger. This applies to many trans people anyway:

Yeah, I think all queer rights stuff fits here. The trans population appears to be roughly evenly divided between gay, bi, ace, and straight people, so as you say it affects a huge fraction.

I have been saying for a while that I expect a court case challenging Obergefell this year, and for it to be overturned by the end of next. Hopefully I am wrong about the final outcome.
