Did that guy at the boarder present his American passport and they still detained him? I never saw anything about that. Maybe that is just assumed and that even after he presented his American passport he was still detained. But the phone thing might be the reason he was detained. Since they can detain even citizens returning to the country to shake them down for access to their phones, as I understand.
This does look to be in line with what can happen when you refuse permission to unlock a gadget, unfortunately.
US border guards cannot compel a person to unlock their device without a court order.
However, US border guards may seize devices, deny non-citizens entry, and take their time processing citizens.
This is accurate. Phones can be searched. My understanding is you can’t be compelled to give your password (as there’s no way to prove you recall it), though they could make your life hell. So, if you turn off your biometrics so they can’t force entry from you, you can in theory have your phone not be searched for non-MAGA-approved content.
That said, we’ve already accidentally deported people and claim to have no way to get them out of prison, so anger CBP at your own risk. Safer to have a burner phone.
So how easy is it to completely backup your phone then factory reset/wipe it then fully restore it?
Asking for a friend.
Probably easier to simply hide your phone in your checked luggage and carry a burner phone.
As soon as you pass customs…switch phones.
Fixed.
Unfortunately I’ll be driving across the border. Might still work i guess. Now to find a cheap burner.
This is SOP for moving to a new phone these days.
It’s somewhat annoying, but not the end of the world.
I’d be more concerned about headaches like corporate token apps.
That would look sufficiently suspicious as to beg trouble. (If your phone is being searched, odds are so’s your luggage.)
I wish Android still had the option to automatically wipe the phone after a certain number of invalid login attempts.
ICE really seems to be struggling to make their quotas of deportations.
He should’ve gone for civil contempt.
The executive branch has several outs from criminal contempt, including refusing to prosecute or pardoning itself.

Trump claims that the SCOTUS case over Garcia that he lost 0-9 was instead a 9-0 win in his favor.
It feels like this is a huge test case. Can they fully lose a court case against SCOTUS, then just ignore it, pretend they won, and have enough people believe that nobody does anything?
If this doesn’t have consequences, what will?
He has had victories in the form of TROs being thrown out, and in the form of the courts being constrained in their power to compel the executive branch to do anything.
We’re running into a fatal flaw of the Constitution – the reliance on the three branches to respect the separation of powers. When the Executive refuses to respect the Judicial, and the Legislative is unable to (or refuses) to step in, there seems to be not a damned thing that can be done about it within the scope of the Constitution, at least not until the next election.
Van Hollen says that he asked the VP of El Salvador why his government continues to hold Abrego Garcia even though he’s not charged with any crime and there’s no evidence that he’s MS-13.
“His answer was that the Trump administration is paying the government of El Salvador to keep him at CECOT”
Not surprisingly, Republican congress critters have been given tours and posted pictures of themselves at CECOT. Van Hollen was not allowed entry.
Love this. The Reddit video is the President of the North American Building Tades Union arguing on Kilmar’s behalf.
That video is a bright spot in a lousy news month.
